Community and Content Guidelines

1. General Rules

This Policy forms part of your agreement with Passes and applies to your use of the platform and all Content on the platform.

1. Do not upload, post, display, or publish Content on Passes that is hateful, fraudulent, defamatory, illegal, discriminatory, menacing, or promotes violence or other illicit activity.
2. Only use Passes for your own personal use.
3. Do not sell, rent, or share your account or any Content obtained from your use of Passes to or with another person.
4. Only use Passes for a purpose and in a manner that is lawful.
5. Do not use Passes in any way that may in effect or in intent exploit or harm any person under 18 years old.
6. Do not post explicit nudity and/or pornography.
7. Do not upload, post, or publish Content on Passes that:
   1. shows, promotes, advertises or refers to:
      • firearms, weapons, or any goods whose sale, possession or use is subject to prohibitions or restrictions;
      • self-harm or suicide;
      • drugs or drug paraphernalia;
      • bestiality;
      • incest;
      • violence, rape, lack of consent, hypnosis, intoxication, sexual assault, torture, sadomasochistic abuse or hardcore bondage, terrorism, extreme fisting, or genital mutilation;
      • necrophilia;
      • urine, scatological, or excrement-related material;
      • “revenge porn”
      • escort services, sex trafficking, or prostitution;
   2. contains or refers to anyone else’s personal data or private or confidential information (for example, telephone numbers, location information (including street addresses and GPS coordinates), names, identity documents, email addresses, log-in credentials for Passes including passwords and security questions, financial information including bank account and credit card details, biometric data, and medical records) without that person’s express written consent;
   3. contains unsolicited sexual content or unsolicited language that sexually objectifies another User or anyone else in a non-consensual way, or contains fake or manipulated sexual content in relation to another User or anyone else (including “deepfakes”);
   4. contains, promotes, advertises or refers to hate speech (being Content intended to vilify, humiliate, dehumanize, exclude, attack, threaten, or incite hatred, fear of, or violence against, a group or individual based on race, ethnicity, national origin, immigration status, caste, religion, gender identity or expression, sexual orientation, age, disability, serious disease, veteran status, or any other protected characteristic);
   5. contains, condones, or promotes terrorist organizations, organized hate, or criminal organizations
   6. is used or is intended to be used to extract money or another benefit from anyone else in exchange for removal of the Content; and/or
   7. gives the impression that it comes from or is approved, licensed or endorsed by Passes or any other person or company when it is not;
   8. involves or promotes third-party commercial activities or sales, such as contests, sweepstakes and other sales promotions, product placements, advertising, or job posting or employment ads without our prior express consent.
8. Do not offer a monetary raffle, lottery, or any other kind of giveaway (collectively, a “Raffle”). Although we recognize a Raffle may enhance engagement with your content, we prohibit Raffles for the purpose of preventing Passes and you from potentially violating applicable gambling laws. We reserve the right, in our sole and absolute discretion, to designate a reward as a Raffle and accordingly prohibit it from Passes. Certain rewards may not violate the prohibition on Raffles. We suggest you contact us at help@passes.com if you are unsure whether a reward violates the prohibition on Raffles. You should consult legal counsel before offering such reward to Members and understand the relevant laws in your jurisdiction.
9. Do not use Passes to stalk, bully, abuse, harass, threaten, or intimidate anyone else.
10. Do not use Passes to engage in misleading or deceptive conduct, or conduct that is likely to mislead or deceive any other User.
11. Do not do anything that violates our or someone else’s rights, including intellectual property rights (examples of which are copyright, trademarks, confidential information, and goodwill), personality rights, unfair competition, privacy, and data protection rights.
12. Do not impersonate us, one of our employees, another User, or any other person or company or falsely state or suggest any affiliation, endorsement, sponsorship between you and us or any other person or company.
13. Do not provide false account registration information or make unauthorized use of anyone else’s information or Content.
14. Do not post or cause to be posted any Content which is spam, which has the intention or effect of artificially increasing any Creator’s views or interactions, or which is otherwise inauthentic, repetitive, misleading, or low quality.
15. Do not use other media or methods (for example the use of codewords or signals) to communicate anything which violates this Policy.
16. Do not reproduce, print, distribute, attempt to download, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any Content, except as permitted under the Terms of Service.
17. Do not knowingly introduce any viruses, trojans, worms, logic bombs or other material into Content which is or may be malicious or technologically harmful.
18. Do not decompile, disassemble, reverse engineer, or otherwise attempt to discover or derive the source code of Passes.
19. Do not use Passes in a way that could adversely affect our systems or security or interfere with any other User’s use of Passes, including their ability to engage in real-time activities through Passes.
20. Do not use any automated program, tool, or process (such as web crawlers, robots, bots, spiders, and automated scripts) to access Passes or any server, network or system associated with Passes, or to extract, scrape, or collect Content or information from Passes.
21. Do not use Passes’s name, logo or any related or similar names, logos, product and service names, designs, or slogans other than in the limited ways which are expressly permitted in the Terms of Service or with our prior written agreement.

2. Nudity

We do not allow explicit adult content, nudity, or pornography. We recognize that not all content is inherently pornographic, such as nudity in art, but we are unable to support any such explicit Content. We also prohibit content depicting or supporting non-consensual sexual acts, the sharing of non-consensual intimate imagery, and adult sexual solicitation. This includes the sale of panties/lingerie/inherently sexual items.

3. Violence & Hateful Behavior

We take a firm stance against enabling violence on Passes. Fans and creators cannot threaten or incite violence or promote dangerous individuals or organizations. When there is a threat to public safety or an account is used to promote or glorify off-platform violence, we may suspend or ban the account. When warranted, we will report threats to relevant legal authorities.

Threats and Incitement to Violence

We consider incitement to violence as advocating for, directing, or encouraging other people to commit violence. We do not allow threats of violence or incitement to violence on our platform that may result in serious physical harm.

Dangerous Individuals and Organizations

We do not allow individuals or organizations on our platform who promote or are engaged in violence. We remove such individuals and organizations, including mass murderers, serial killers and rapists, hate groups, criminal organizations, terrorist organizations, and other non-state armed groups that target civilians.

Terrorist Organizations

Terrorists and terrorist organizations are non-state actors that threaten violence, use violence, and/or commit serious crimes (such as crimes against humanity) against civilian populations in pursuit of political, religious, ethnic, or ideological objectives.

Organized Hate

Organized hate refers to those individuals and organizations who attack people based on protected characteristics, such as race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender, gender identity, or immigration status. We consider attacks to include actions that incite violence or hatred, dehumanize individuals or groups, or embrace a hateful ideology.

Criminal Organizations

Criminal organizations are transnational, national, or local groups that have engaged in serious crimes, including violent crimes (e.g., homicide, rape, robbery, assault), trafficking (e.g., human, organ, drug, weapons), kidnapping, financial crimes (e.g., extortion, blackmail, fraud, money laundering), or cybercrime.

Violent and Graphic Content

We do not allow content that is gratuitously shocking, graphic, sadistic, or gruesome or that promotes, normalizes, or glorifies extreme violence or suffering on our platform. When there is a threat to public safety, we suspend or ban the account and, when warranted, we will report it to relevant legal authorities.

4. Hate & Discrimination

Passes was founded with inclusivity and safety in mind. We have a zero-tolerance policy against discrimination. Content that contains hate speech or hateful behavior will be removed from the platform, and the offending account will be suspended or banned.

Attacks on the Basis of Protected Attributes

We define hate speech or behavior as content that attacks, threatens, incites violence against, or otherwise dehumanizes an individual or a group on the basis of the following protected attributes:

• Race
• Ethnicity
• National origin
• Religion
• Caste
• Sexual Orientation
• Sex
• Gender
• Gender identity
• Serious disease
• Disability
• Immigration status

Hateful Ideology

Hateful ideologies are those that demonstrate clear hostility toward people because of their protected attributes. Hateful ideologies are incompatible with the inclusive and supportive community that our platform provides and we remove content that promotes them.

5. Illicit Activities

We work to ensure Passes does not enable activities that violate laws or regulations. We prohibit the trade, sale, promotion, and use of certain regulated goods, as well as the depiction, promotion, or facilitation of criminal activities, including human exploitation. Content may be removed if it relates to activities or goods that are illegal in the jurisdiction of posting.

Criminal Activities

Criminal activities cover a wide spectrum of acts punishable by law, including theft, assault, human exploitation, counterfeiting, and other harmful behavior. To prevent such behavior from being normalized, imitated, or facilitated, we remove content that promotes or enables criminal activities.

Frauds and Scams

We do not permit anyone to exploit our platform to take advantage of the trust of users and bring about financial or personal harm. We remove content that deceives people in order to gain an unlawful financial or personal advantage, including schemes to defraud individuals or steal assets.

Cannabis Usage

Depictions of cannabis usage and paraphernalia are allowed on Passes, so long as your current place of residence has legalized cannabis usage. Any content that includes cannabis usage and paraphernalia while the creator is living in a city, county, state, country, etc. where such usage is illegal is not allowed.

6. Suicide, Self-Harm, and Dangerous Acts

The mental health of our creators and users is incredibly important to us. As such, we will remove content that promotes, normalizes, or glorifies activities that could lead to suicide or self-harm (including eating disorders). We do not permit users to share content depicting them engaging in, or encouraging others to engage in, dangerous activities that may lead to serious injury or death, including the aforementioned activities. However, if creators and users wish to speak on their personal experiences regarding these issues in order to raise awareness or to find community support and solidarity, we encourage that.

Suicide

We remove content that displays suicide, suicidal ideation, or content that might encourage participation in other self-injurious behavior. We also remove content that depicts attempted suicide or content featuring a person engaging in behavior or intending to engage in behavior that is likely to lead to self-inflicted death. We prohibit any form of content that promotes, normalizes, or glorifies suicide, provides instructions for suicide, or posts that portray a suicide as heroic or honorable.

7. Harassment and Abusive Behavior

We remove all expressions of abuse, including threats or degrading statements intended to mock, humiliate, embarrass, intimidate, or hurt an individual. To enable expression about matters of public interest, critical comments of public figures may be allowed; however, serious abusive behavior against public figures is prohibited.

Coordinated Harassment

We want to ensure that users and creators can create content and engage with their community in a space where they feel safe to do so. Please note that we can only take action for behaviors violating TOS that occur within our platform. Unfortunately, we have no jurisdiction over things that occur off of Passes, and we will not be able to assist with requests for reports of this nature.

Our team takes reports of harassment very seriously, and in cases of coordinated harassment that are not allowed, this can include but is not limited to:

• Deliberate calls to action to mass report someone on or off-platform
• Content that provides detailed plans to harass another person on or off-platform

We understand that calls to action can fall on a very fine line, and we want to make sure that users and creators alike feel safe on our platform while ensuring that this type of posting isn’t weaponized on our platform and used in bad faith.

Any reports of this nature are taken into very careful consideration, and the decisions made by our team are not made lightly, and are usually made in order to mitigate further escalation as much as possible.

Sexual Harassment

Sexual harassment involves unwanted or inappropriate sexual behavior directed at another individual. We do not allow content, including comments or advances, that sexually harasses others, regardless of user’s intent, as such actions can cause great distress to targeted individuals.

8. Privacy, Personal Data, and Personally Identifiable Information (PII)

We do not allow content that violates the confidentiality of personal data or personally identifiable information (e.g., social security information). We remove content that depicts personal data or personally identifiable information (PII) from the platform.

Threats of Hacking, Doxxing, and Blackmail

Threatening to hack or dox with an intent to harass or blackmail another individual can cause serious emotional distress and other offline harm. We define doxxing as the act of collecting and publishing personal data or personally identifiable information (PII) for malicious purposes. We consider these online behaviors as forms of abuse and do not allow them on our platform.

9. Spam and Solicitation

Passes was created to foster authentic fan communities and for creators to bring their existing fanbase to support them on Passes. We do not allow activities that undermine the integrity of our platform (such as funneling or redirecting to NSFW platforms) or the authenticity of our users. We remove content or accounts that involve spam or fake engagement, impersonation, misleading information that causes harm, or that violate any intellectual property rights.

Spam and Fake Engagement

Fake engagement includes any content or activity that seeks to artificially inflate popularity on the platform. We prohibit any attempts to manipulate the platform to increase interaction metrics.

Solicitation and Funneling

Funneling is a term used to describe egregious promotion on a creator’s Passes (via public/private posts, housechats and/or direct messages) in order to send their fans to any NSFW or other adult monetization platform(s), which includes, but is not limited to: OnlyFans, Fansly, 18+ Snapchats, adult-themed Patreons, and monetized, adult-themed Twitter pages.

Examples of funneling language that is not allowed:

• “Just posted new content on my OnlyFans! Check it out!”
• “Check out my ____”
• “Follow me on ____”
• “You can find me on ____”

As Passes is a PG-13 platform that hosts minors, any direct calls to action to visit or promotion of NSFW or adult platforms is strictly prohibited. The only appropriate space for creators to have any direct link to additional NSFW monetization platforms is via a LinkTree, Beacons, or other link aggregator, that can be listed in their Passes bio. Direct linking or calls to action to a NSFW platform within the bio, captions, text/audio/video posts is not permitted. Any additional promotion or direction of your fans towards these additional sites is not allowed.

10. Impersonation

We do not allow accounts that pose as another person or entity in a deceptive manner. When we confirm a report of impersonation, we will ask the user to revise the profile or suspend or ban the account.

Misinformation

Misinformation is defined as content that is inaccurate or false. While we encourage our community to have respectful conversations about subjects that matter to them, we do not permit misinformation that causes harm to individuals, our community, or the larger public regardless of intent.

11. Intellectual Property Violations

Copyright is a legal right that protects original works of authorship (e.g., music, videos) and original expression of an idea (e.g., the specific way a video or music is expressed or created), although it does not protect underlying ideas or facts. A trademark is a word, symbol, slogan, design that identifies and distinguishes the source of a product or service. We encourage everyone to create and share original content. Content that infringes someone else’s intellectual property rights is prohibited on our platform and will be removed if we become aware of it. The use of copyrighted work under certain circumstances, such as the fair use doctrine or other applicable laws, or the use of a trademark to reference, lawfully comment, criticize, parody, make a fan page, or review a product or service may not be considered a violation of our policies.

12. Platform Security

Our policies prohibit any activities that undermine the security and reliability of the Passes service:

• Do not hack the Passes website, app, or associated networks, or bypass its measures to restrict user access
• Do not distribute files that contain viruses, Trojan horses, worms, logic bombs, or other materials that are malicious or harmful
• Do not modify, adapt, translate, reverse engineer, disassemble, decompile, or create any derivative products based on Passes, including any files, tables or documentation, nor attempt to regenerate any source code, algorithms, methods, or techniques embodied in Passes
• Do not use automated scripts to collect information from Passes

13. Minor Safety

We are committed to protecting minors on Passes. We do not tolerate acts that abuse, endanger, or exploit of any person under the age of 18 (a “minor”). Any content, including animation or digitally created or manipulated media (including “deepfakes”), that depicts abuse, exploitation, or nudity of minors is a violation on our platform and will be removed when detected. CSAM is any image or video of sexually explicit conduct, including nudity, involving a person less than 18 years old. These images amount to child sexual abuse and exploitation (CSAE).

If we identify suspected CSAM on Passes, we immediately remove it, and make a “CyberTipline” report to the National Center for Missing & Exploited Children (NCMEC) and/or other relevant legal authorities. NCMEC reviews these reports and shares them with the relevant law enforcement so they can combat CSAM. We immediately investigate any user who tries to share suspected CSAM on Passes and we take appropriate action. We ban anyone who tries to create or distribute CSAM on Passes.

Grooming Behavior

Grooming behaviors are those in which an adult builds an emotional relationship with a minor in order to gain the minor’s trust for the purposes of future or ongoing sexual contact, sexual abuse, trafficking, or other exploitation. These behaviors include: flattery, requests for contact on or off platform, requests for personal information, solicitation of minor sexual abuse material, sexual solicitations or comments, and gift-giving.

Nudity and Sexual Activity Involving Minors

Nudity and sexual activity involving minors include content that is revealing of breasts, genitals, anus, or buttocks, or behaviors that mimic, imply, or display sex acts involving minors. We do not allow the depiction, including digitally created or manipulated content, of nudity or sexual activity.

Harmful Activities by Minors

Harmful minor activities include the possession or consumption of substances prohibited for minors, the misuse of legal substances, engagement in illegal activities, participation in activities, physical challenges, or dares that may threaten the well-being of minors. We remove any such content from our platform.

Physical and Psychological Harm of Minors

Behaviors that place minors at risk of physical or psychological harm include physical abuse, neglect, endangerment, and psychological disparagement. We remove any such content from our platform.

Crimes Against Children

We do not allow users who have been convicted of crimes against children to have an account on our platform. These crimes include: sexual assault, molestation, murder, physical abuse or neglect, abduction, international parental kidnapping, trafficking, exploitation of minors for prostitution, live online sexual abuse of a minor, sexual exploitation of minors in the context of travel and tourism, attempts to obtain or distribute child sexual abuse material (CSAM), and the production, possession, or distribution of child sexual abuse material (CSAM). If we discover any such users, we ban the account. Any self-disclosed user information that states the account holder is a pedophile or minor sex offender will be taken at face value and the account may be deleted.

Fans who are 13–17 years old on Passes

We believe that 13–17 year olds should have access to engage with their favorite age-appropriate creators and participate in their online community. To ensure that these fans are safe on our platform, they are subject to additional security measures to ensure that their experience on our platform is age-appropriate.

These steps include, but are not limited to, the following:

• 13–17 yo fans may not receive DMs
• 13–17 yo fans will only be able to view content that is appropriate for their age, based on our internal rating system; all creators who exceed the PG-13 rating will not be visible or discoverable to 13–17 yo fans
